What is a "Permanent Establishment"? It's a tax concept: if your company, without being formally incorporated in Spain, ends up having a sufficient presence here (an office, staff, a construction project, or someone negotiating contracts on your behalf), the Spanish tax authorities can consider that you have an "establishment" in Spain and that you must pay tax here on the related business. Many companies are surprised to find this can happen even without opening any formal subsidiary or branch.
How does this tool work? We'll ask you, step by step, about your company's activity in Spain: whether you have any office or space, whether people work here (including remotely), whether there's a construction or installation project, and whether anyone acts commercially on your behalf. Based on your answers, we give you an indicative risk rating for each scenario.
